Terms of Service

1. Purpose and acceptance

These terms (the "Terms") govern access to and use of the Epovest service (the "Service"), published by Sels de Rehy, LLC (the "Provider", "we"), whose details appear in the Legal Notice.

By creating an account, buying credits or using the Service, you (the "Customer", "you") accept these Terms without reservation. If you act on behalf of a legal entity, you represent that you have authority to bind it.

2. Description of the Service

Epovest is an online service that measures the visibility of an entity in the answers of artificial-intelligence engines (in particular ChatGPT, Claude, Gemini, Perplexity, Mistral and Grok). The Service periodically queries these engines using a panel of queries, archives the answers obtained, extracts mentions and sources, and reports indicators and reports to the Customer.

The precise functional scope (number of prompts and keywords, survey frequency, engines covered) is the one described in the offer in force on the date of the order.

3. Best-efforts obligation: no guarantee of result

The Service is a measurement service. It provides a snapshot of what AI engines answer at a given time; it does not produce, influence or guarantee any visibility, citation, mention, ranking or recommendation.

The Provider is bound by a best-efforts obligation: it applies reasonable diligence to run the surveys and report the measurements. The Provider does not guarantee:

  • that a tracked keyword will be cited, mentioned or recommended by any AI engine;
  • any movement, upward or downward, of any indicator;
  • the accuracy, completeness or availability of the answers provided by third-party AI engines, over which the Provider has no control.

AI-engine answers are by nature variable and probabilistic. The reported measurements reflect those answers as observed and constitute neither advice, nor a commercial promise, nor a performance guarantee.

4. Account

Use of the Service requires creating an account. You undertake to provide accurate information and keep it up to date, and to keep your credentials confidential. Verification of your email address is required before any payment.

An account may include several members with distinct roles (owner, manager, operator). The owner is responsible for managing members and the credit balance. You are responsible for any activity carried out under your account.

5. Prices, taxes and payment

5.1 Prices. The Service runs on prepaid credits: you buy a credit balance that is debited as your checks run. The billing unit is the check (one prompt asked to one AI engine), priced at $0.10 per check; higher measurement resolutions multiply the unit (Full HD ×3, 4K ×6, 8K ×9). Optional AI analysts (sentiment, custom analysis) are metered at $0.05 per analysed answer each, on the same unit as the checks. The cost of a tracker follows from its configuration (prompts × engines × checks × resolution, plus its AI analysts). Automatic corroboration monitoring, where you enable it on a recorded page, is metered at $0.02 per executed monitoring check, at the cadence set page by page; checking a page on demand is free of charge. The minimum top-up is $10. Prices are displayed in US dollars (USD). The applicable prices are those displayed at the time of purchase. The Provider may change its prices (see section 11).

5.2 Taxes. Prices are stated exclusive of any applicable taxes. A business Customer established in the European Union shall, where applicable, account for VAT under the reverse-charge mechanism. Any tax due by reason of the Customer's place of establishment or residence is added where applicable and borne by the Customer.

5.3 Payment. Payment is made by card, processed by our payment provider. Sels de Rehy, LLC is the seller and the issuer of invoices. No card data is stored by the Provider. Buying credits is a one-off payment: there is no subscription and no automatic renewal. You may, if you wish, save a card and enable auto-reload: you set its trigger threshold, the amount and a monthly limit, and you can change or turn it off at any time. No amount is then charged unless your balance falls below the threshold you set.

6. Credits and balance

The Service has no fixed term and no subscription. The credits you buy do not expire: your balance remains available until your trackers consume it. You may stop using the Service at any time; not buying incurs no charge.

Save for any mandatory provision to the contrary or applicable withdrawal right (section 7), amounts corresponding to consumed credits are non-refundable. The measurement series already built is retained and resumes identically as soon as your balance is topped up again; it is never deleted as a result of your balance running out, subject to section 10.

7. Right of withdrawal (consumers)

If you are a consumer residing in the European Union, you are in principle entitled to a fourteen (14) day period to withdraw, without reason.

As the Service is digital content and a digital service performed immediately, you expressly consent, when buying credits, to performance possibly beginning before the end of that period and acknowledge losing your right of withdrawal over credits already consumed. Credits bought but not yet consumed may be refunded to you if you exercise your withdrawal right within the period by writing to support@epovest.com.

This clause applies without prejudice to the mandatory rights granted to consumers by the law of their country of residence.

8. Customer obligations

You undertake to use the Service lawfully, to track only keywords in which you have a legitimate interest, not to attempt to circumvent the Service's technical limits, not to resell it or massively extract its data without authorization, and not to impair its integrity or security.

9. Intellectual property

The Service, the platform, the measurement methodology, the indicators and the aggregated data remain the exclusive property of the Provider. The Provider grants you a personal, non-exclusive and non-transferable right of use, limited to the duration of your use of the Service.

The data and content you provide (in particular the configuration of your trackers: prompts and keywords) remain yours; you grant the Provider the right to process them solely to perform the Service. The reports delivered to you may be used freely by you, provided their content is not distorted.

10. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

11. Availability, evolution and amendment of the Terms

The Provider endeavours to ensure the availability of the Service but makes no firm service-level commitment; interruptions for maintenance or for reasons beyond its control may occur. The Provider may make the Service evolve.

The Provider may amend these Terms; material changes are notified to you by reasonable means. They apply to purchases and use of the Service after they come into force. Any change to the unit price applies only to checks run after it comes into force; the credit balance already acquired keeps its monetary value.

12. Suspension and termination for breach

When your credit balance is exhausted, surveys are automatically paused and the measurement series is retained; they resume as soon as your balance is topped up. In the event of a serious breach of these Terms, the Provider may suspend or terminate access, after formal notice left without effect where the nature of the breach so permits.

13. Liability

The Service is provided "as is". To the extent permitted by law, the Provider shall not be liable for indirect or intangible damages (loss of revenue, customers, data, image or opportunity), nor for decisions made by the Customer on the basis of the measurements provided. The Provider's total liability, on any basis whatsoever, is limited to the amounts actually paid by the Customer during the twelve (12) months preceding the triggering event.

Nothing in these Terms limits liability that cannot be limited under applicable law (in particular fraud, gross negligence, or the mandatory rights of consumers).

14. Force majeure

Neither party is liable for a failure resulting from force majeure or an event beyond its reasonable control, including the failure or unavailability of a third-party AI engine or infrastructure provider.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware (United States), without prejudice to the mandatory consumer-protection provisions of the consumer's country of residence. Any dispute falls within the competent courts of the State of Delaware, subject to the same reservation.

16. Miscellaneous

If any provision is held invalid, the remainder continue to apply. The Customer may not assign the contract without the Provider's written consent. These Terms constitute the entire agreement relating to the Service.

Language. These Terms are available in several languages. The English version is authoritative and prevails; the other languages are provided for convenience. This is without prejudice to the mandatory rights of consumers, including, where the applicable law so requires, the right to the contract drawn up in their own language (in particular French in Québec).
